These Terms of Service (“Terms”) govern access to and use of PottMenu’s website, mobile application, and related services (together, the “Platform”), operated by PottMenu, Inc. (“PottMenu,” “we,” “us”). By creating an account or otherwise using the Platform, you agree to these Terms.
1. Eligibility
The Platform is intended for adults 21 years of age or older, or the legal age of majority for cannabis-related content in your jurisdiction, whichever is higher. By using the Platform, you represent that you meet this requirement and that your use complies with the laws of your state or territory.
2. What PottMenu is — and is not
PottMenu is an identity, discovery, and follow layer for licensed cannabis growers, dispensaries, and consumers. PottMenu does not cultivate, package, sell, deliver, or take title to any cannabis product, and PottMenu does not process payment for any cannabis sale. All purchases occur directly between a consumer and a licensed dispensary or retailer, subject to that retailer’s own terms and applicable state and local law.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Grower accounts are subject to license verification as described in our Verified Grower Policy.
4. Harvest Cards and content
Growers are responsible for the accuracy of information published in a Harvest Card, including cultivar, harvest window, and cultivation details. PottMenu may remove or restrict a Harvest Card that violates these Terms, our Community Standards, or applicable law.
5. Prohibited conduct
- Misrepresenting your identity, age, or license status
- Advertising or facilitating unlicensed cannabis sales
- Shipping or offering to ship cannabis across state lines
- Scraping, reverse engineering, or interfering with the Platform
- Using the Platform to target or market to minors
6. Disclaimers
The Platform is provided “as is” without warranties of any kind. Cannabis remains illegal under U.S. federal law; PottMenu makes no representation about the legality of cannabis in your specific location and it is your responsibility to comply with local law.
7. Limitation of liability
To the maximum extent permitted by law, PottMenu is not liable for indirect, incidental, or consequential damages arising from your use of the Platform, including any transaction with a dispensary or grower discovered through the Platform.
8. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date above. Continued use of the Platform after changes take effect constitutes acceptance.
